A redefinition and delimitation plan ensures legal boundaries regarding your property are legally recognized. A property owner does it through the lodgement of a project at Land Registry Services. A Registered Surveyor must carry out these Surveys.
A Redefinition plan is a requirement before you lodge a Strata Plan. It depends on the age of the latest project attached to the subject property. It may also be required by Council when submitting plans through your local Council where the boundary’s exact position is unclear.
A Delimitation plan is especially a requirement should you wish to remove the notation of ‘Limited Title’ on your Certificate of Title. It is the only way to remove this notation of the Title. If this notation is on your Certificate of Title, your property is Old System Title. The removal of this notation will assist in bringing your property into Torrens Title.
Hence, a redefinition and delimitation plan is essential for your property.
Redefinition plans mean redefining the boundaries of a particular parcel of land. People undertake redefinition plans when the boundaries of the property need more definition. The only way to re-establish these boundaries is by completing a Redefinition Survey. Finally, you lodge the plan and associated documents with Land Registry Services. The surveyors should know the specifics of these surveys and the process of registering these plans. ARP Surveyors intimately know these essential details.
Our team has handled many Redefinition Surveys and, where appropriate, Strata subdivision plans on top of this. The main reason for these Redefinition plans is for Strata Subdivisions. Coordinating base plans with survey marks across the state is a requirement for Strata Plans. The only way to complete this coordination for an old subdivision is to complete a Redefinition. Do it over the parent parcel before Strata Subdivision. Otherwise, the authorities will not accept the Strata Plan when you lodge it for registration. Land Registry needs these plans alongside the strata plan. If you do not have it, they can’t accept it.
The land is ‘Old System’ if there is the notation of ‘Limited Title’ and ‘Qualified Title’ on the Certificate of Title. The Limited Title indicates that nobody investigated the property’s boundaries adequately. However, the only way to remove this notation is to complete and lodge a plan of Delimitation with Land Registry Services.
